What to Expect with Your Divorce Case
Navigating the divorce process is not an easy process. It is important to know what to expect and how to best deal with the complications that arise. Here is a basic overview of the process so you are aware of where this is headed:
Filing the divorce complaint - Either party will need to file a divorce complaint with the court to get the process started. The other party will then file an answer perhaps with a counterclaim.
Exchange financial information - Next, both parties will disclose and exchange their financial information, including the Court's Financial Statement form signed under the penalty of perjury.
Rights & responsibilities until your divorce is final - If you and your spouse cannot agree on how to do things until your divorce is finalized. We will attempt to negotiate temporary financial and parenting rights and responsibilities and if necessary, schedule a court hearing to obtain appropriate Temporary Orders to maintain the status quo until a final resolution.
Settlement "Separation Agreement" - At some point, whether before or after filing the complaint, the parties will try to reach an agreement to settle. If no settlement is reached, the parties will attend a Pretrial Conference with a Judge, who will attempt to assist to resolve unresolved issues and determine what remains to be done to prepare the matter for trial.
Resolution out of court - In most cases, mediation or conciliation will be attempted to come to an agreement on financial matters of the divorce. If this cannot be accomplished through alternative dispute resolution, the matter will proceed to trail.
Trial - If no agreement can be reached through the above process, trial will then be scheduled.
